DocsInk, LLC provides patient monitoring and telehealth services to health care providers and their patients (the “Services”). This Privacy Policy describes the information DocsInk, LLC collects about you, how we use or share your information, your rights and choices with regard to such information and steps we take to secure your information. This Privacy Policy applies to information collected by or on behalf of DocsInk, LLC (“DocsInk”, “we”, “us”), including but not limited to certain personal information collected from patients of enrolled providers through our web-based and mobile patient application (the “App”), by phone, our chat and technical support features, or anywhere else we display this Privacy Policy (collectively, the “Platform”). Only patients of health care providers who have enrolled in the Services (“Providers”) can register for our Services. When you register through our Platform, we will share certain individually identifiable health information and protected health information (“Personal Information”) with your Provider. The information we collect about you through the Platform on behalf of your Provider is also subject to the Notice of Privacy Practices and other privacy policies you agreed to with your Provider. Contact your Provider for information on how your Provider may use or disclose your Personal Information obtained through the Services. This Privacy Policy describes how DocsInk uses your Personal Information to provide the Services. When you register for the Services or interact with us through the Platform, you agree to have your Personal Information used, disclosed or processed in accordance with this Privacy Policy in effect at the time of your use.
INFORMATION WE COLLECT
We collect your Personal Information in the following ways when you access or interact with the Platform or otherwise use the Services:
- Information You Provide. We access and collect Personal Information that you voluntarily give us, including email or other direct contact information. For example, you may provide your name and email address to set up your account. We may also collect your username and password to establish your log-in credentials to authenticate your access to the Services.
- Information Collected Automatically. We may also automatically collect certain information using “cookies” when you access the App. A cookie is a small data file stored on your browser. We use cookies to collect information such as your IP address, device ID, browser type and similar information related to your interaction with the Platform, to help us improve your access to the App. This information typically remains in aggregate form and does not identify you individually but if it does, we will treat the information as Personal Information. You can adjust your device or browser settings to disable or reject cookies but if you disable all cookies, you may be unable to access all functionality of the App. We do not permit third parties to track your activities over time and across other websites based on your use of the App.
- Your Device Bluetooth and Location Services. When you authorize and enable our access to your connected devices such as odometers, blood pressure devices or similar
technology or apps on your mobile device, will access your Bluetooth and locationservices. The Bluetooth and location services are used to detect nearby Bluetooth- enabled devices. We will only access these devices and allow the devices to connect to the Services when you approve and select the device. Once connected, the device data and readings will transfer directly to DocsInk for your Provider’s review. The App will disconnect from your Bluetooth and location services when the device is disconnected. - Health and Device Information. We will collect information from you or from health apps or connected devices that you authorize for access to the Services, including information about your health conditions and related factors such as your age, gender, weight, height, medical history, symptoms; appointment information; and communications between you and your Provider as necessary to provide the Services.
HOW WE USE INFORMATION
We use your Personal Information to provide the Services, to respond to your questions or requests, to address any other reason you contacted us or to otherwise communicate with you.
We may also use your information to:
· Enhance our Services and the Platform
· Detect and prevent fraud and maintain the security of the Services
· Comply with our legal obligations and protect our legal rights or the health and safety of you or the others
· Ensure and enforce your compliance with our End User License Agreement or the terms of any other applicable services agreement we have with you
· Send you information about changes to our terms, conditions, and policies
· Allow us to pursue available remedies or limit the damages that we may sustain
WHEN WE SHARE INFORMATION
We may share your information with:
· Your Provider.
· Service providers engaged to provide services to support our operations and the Services. Our service providers are contractually required to protect your information and only use your information to provide services to us.
· A successor entity in the event of a corporate merger, consolidation, sale of assets or other corporate changes to DocsInk.
· Other third parties as necessary to protect our legal interests or property, to comply with applicable laws and regulations or other legal requirements, or to protect your health and safety or the health and safety of others.
YOUR RIGHTS AND CHOICES
You may update or amend your information by contacting us via the email address or phone number included in the Contact Us section at the bottom of this Privacy Policy.
SECURITY
We maintain safeguards and controls designed to help protect Personal Information from unauthorized access or disclosure. However, the security of information transmitted over the Internet is never 100% effective, and we cannot guarantee the security of information you transmit across the Internet. You are responsible for taking precautions to protect your user ID, password, and other user account information (“User Credentials”) from disclosure to third parties, and you are not permitted to circumvent the use of required encryption technologies. You should immediately notify us if you know of or suspect any unauthorized use or disclosure of User Credentials.
“DO NOT TRACK” Signals
Some browsers have “do not track” features that allow you to tell a website not to track you.
These features are not all uniform. The App does not currently respond to browser-based “Do Not Track” signals.
LINKS TO OTHER SITES
We may provide links through the App to third-party websites or apps as necessary to connect the Services to your other health apps or devices you authorize. Please be aware that those websites and apps are independent from DocsInk and we are not responsible for the content or privacy practices of such other sites or apps. Therefore, we encourage our users to be aware when they leave the App and to read the privacy policies of any other website or app you visit.
INTERNATIONAL USERS
DocsInk is based in the United States and our Services are operated in the United States. Our Services are not targeted at individuals outside the United States. If you are visiting the Platform from outside the United States and provide us with Personal Information, please note that your information will be accessed or transferred, stored and processed by DocsInk in the United States. The data protection or privacy laws in the United States may be different than those in your country. By doing business with or interacting with DocsInk through the Platform or our Services, you acknowledge and agree to the transfer of your Personal Information to facilities located in the United States and understand that such information will be stored and processed in accordance with this Privacy Policy and the laws of the United States.
NOTICE TO CALIFORNIA RESIDENTS
Under California Civil Code § 1798.83, California residents with whom we have a business relationship can request information about the types of Personal Information, if any, we shared with third parties for the direct marketing purposes of the third parties and the identities of the third parties with whom we shared such information in the last 12 months. We do not share your Personal Information with third parties in this manner and have not done so in the last 12 months. You may request more information by contacting us using the contact information at the bottom of this Privacy Policy.
CHILDREN’S PRIVACY
The Platform is not intended for use by children under the age of 13. We do not knowingly collect or solicit any Personal Information from children under the age of 13. Should we learn that someone under the age of 13 has provided any Personal Information to or on the Platform, we will remove that information as soon as possible.
UPDATES TO OUR PRIVACY POLICY
We reserve the right to modify this Privacy Policy at any time and may apply changes to previously collected information, as permitted by applicable law. Any updates to this Privacy Policy will be posted on the Platform or through the Services and we will indicate the last updated date of the changes. Your continued use of the Services means you accept those changes as of the posted last updated date.
