This Privacy Policy describes the information DocsInk, LLC collects about you, how we use or share that information, your rights and choices with regard to such information and steps we take to secure your information. This Privacy Policy applies to personal information collected by or on behalf of DocsInk, LLC (“DocsInk”, “we”, “us”), including but not limited to personal information collected through our website www.docsink.com and mobile versions of our website (collectively, the “Site”), our mobile applications and platforms (collectively, the “Apps”), by phone, our chat and technical support features, or anywhere else we display this Privacy Policy (collectively, with the Site and the Apps referred to as the “Services”). By using or interacting with the Services, you agree to have your information used, disclosed or processed in accordance with this Privacy Policy in effect at the time of your visit or use.

This Privacy Policy does not apply to protected health information we collect from or on behalf of our customers (health care providers and institutions), which is governed by our End User License Agreement and Business Associate Agreement. If you are a registered patient, the information we collect about you through the Services on behalf of your provider, including protected health information, is subject to the Notice of Privacy Practices and other privacy policies you agreed to with your provider. 

INFORMATION WE COLLECT

Personal information is information that directly or indirectly identifies or can be used to identify you as an individual.  We generally collect information in the following ways when you access or interact with the Services:

    • Information You Provide. We access and collect information that you voluntarily give us via the Services, including email or other direct contact information. For example, you may provide your name and professional business contact information (such as your organization’s name, job title or business email address or phone number) when you contact us using the contact form on the Site or by phone or email. If you are a registered end user of the Services (“End User”), we may also collect your username, password and other information necessary to set up your account. 

    • Information Collected Automatically. We may also automatically collect certain information when you access the Site or Apps using tools such as pixels or “cookies.” A cookie is a small data file stored on your hard browser if you visit the Site. We use pixels and cookies to collect information such as your IP address, device ID, browser type, pages you visit on the Site and duration on those pages, and similar information related to your interaction with the Site, to help us improve your access to the Site and identify repeat visitors to the Site. Cookies can also enable us to track and target the interests of our users to enhance the experience and operation of the Site. This information typically remains in aggregate form and does not identify you individually but if it does, we will treat the information as personal information. You can adjust your browser settings to disable or reject cookies but if you disable all cookies, you may be unable to access all functionality of the Site. We do not permit third parties to track your online activities over time and across other websites based on your use of the Site.

The Site also uses analytics tools such as Google Analytics, a web analytics service provided by Google, Inc. that uses cookies to help the Site analyze how users navigate the Site. The information generated by the cookie about your use of the Site (including your IP address) will be transmitted to and stored by Google in aggregate form. Google uses this aggregated information on our behalf in order to evaluate use of the Site, compile reports on Site activity and other services relating to Site activity and usage.     • Job Applicants and Candidates. We collect and maintain personal information of job applicants and candidates who seek to be employed by us or otherwise apply for job openings. This personal information includes, but is not limited to job applicant or candidate first and last name, email address, telephone number, physical address, desired pay, available start date, link to social media profile, gender, ethnicity, disability and veteran status, educational history, date of birth, references, job history and any other information you choose to provide as part of your resume or application for employment. We collect and maintain this information to determine eligibility for employment, including verification of references and qualifications; assessing qualifications for a particular job; complying with applicable labor or employment rules, regulations, and statutes, or for such other purposes as are reasonably required by us as otherwise set forth in this Privacy Policy; or to communicate with you about your application for employment or potential job openings. We may share this information with our service providers as necessary for the purposes of determining your eligibility and qualifications. 

HOW WE USE INFORMATION

We use your information for our business and commercial purposes, to provide our services and products, to respond to your questions or requests, to address any other reason you contacted us or to otherwise communicate with you. We may also use your information to: 

    • Enhance our products and services and related data analytics

    • Detect and prevent fraud and maintain the security of the Services

    • Comply with our legal obligations and protect our legal rights or the health and safety of you or the others

WHEN WE SHARE INFORMATION

We do not rent or sell your information and will not share your information with any third party outside of our corporate organization, other than described in this Privacy Policy or with your consent. We may share your information with:

    • Service providers engaged to provide services to support our operations and other business and commercial purposes such as support services. Our service providers are contractually required to protect your information and only use your information to provide services to us.

    • Your healthcare provider if you are a patient End User and have registered for the Services made available to you by your provider. 

    • A successor entity in the event of a corporate merger, consolidation, sale of assets or other corporate changes to DocsInk.

    • Other third parties as necessary to protect our legal interests or property, to comply with applicable laws and regulations or other legal requirements, or to protect your health and safety or the health and safety of others.  

YOUR RIGHTS AND CHOICES

You may opt out of receiving communications from us at any time by contacting us using the methods listed in the Contact Us section at the bottom of this Privacy Policy or by using the unsubscribe links included in communications from us. Please note that even if you unsubscribe from our marketing communications, you may still receive emails or other communications related to your transactions with us. You may also update or amend your information by contacting us via the email address or phone number included in the Contact Us section at the bottom of this Privacy Policy.

SECURITY

We maintain safeguards and controls designed to help protect personal information from unauthorized access or disclosure.  However, the security of information transmitted over the Internet is never 100% effective, and we cannot guarantee the security of information you transmit across the Internet.

“DO NOT TRACK” SIGNALS

Some browsers have “do not track” features that allow you to tell a website not to track you. These features are not all uniform. The Site does not currently respond to browser-based “Do Not Track” signals.

LINKS TO OTHER SITES

We may provide links on the Site to third-party websites we think may be of interest to you, including links to social media sites such as LinkedIn, Facebook, Twitter and YouTube.  Please be aware that these websites are independent from DocsInk, and we are not responsible for the content or privacy practices of such other sites or platforms. When you click on links on the Site that take you to a third-party website, you will be subject to the third party’s privacy policies. Therefore, we encourage our users to be aware when they leave the Site and to read the privacy policies of any other website you visit.

INTERNATIONAL USERS

DocsInk is based in the United States and our Services are operated in the United States. Our Services are not targeted at individuals outside the United States. If you are visiting the Services from outside the United States and provide us with personal information, please note that your information will be accessed or transferred, stored and processed by DocsInk in the United States. The data protection or privacy laws in the United States may be different than those in your country. By doing business with or interacting with DocsInk or our Services, you acknowledge and agree to the transfer of your personal information to facilities located in the United States and understand that such information will be stored and processed in accordance with this Privacy Policy and the laws of the United States.

NOTICE TO CALIFORNIA RESIDENTS

Under California Civil Code § 1798.83, California residents with whom we have a business relationship can request information about the types of personal information, if any, we shared with third parties for the direct marketing purposes of the third parties and the identities of the third parties with whom we shared such information in the last 12 months. We do not share your personal information with third parties in this manner and have not done so in the last 12 months. You may request more information by contacting us using the contact information at the bottom of this Privacy Policy.

CHILDREN’S PRIVACY

The Site is not intended for use by children under the age of 13. We do not knowingly collect or solicit any personal information from children under the age of 13. Should we learn that someone under the age of 13 has provided any personal information to or on the Site, we will remove that information as soon as possible.

UPDATES TO OUR PRIVACY POLICY

We reserve the right to modify this Privacy Policy at any time and may apply changes to previously collected information, as permitted by applicable law. Any updates to this Privacy Policy will be posted on the Site or through the Services and we will indicate the last updated date of the changes. Your continued use of the Services means you accept those changes as of the posted last updated date.
